Carwen Customer Agreement
This Customer Agreement ("Agreement") is entered into between Carwen Pty Ltd ("Carwen," "we," "our," or "us") and you, the customer ("Customer," "you," or "your"). This Agreement outlines the terms and conditions for customers using the Carwen platform in Sydney and Melbourne, Australia.
1. Acceptance of Terms
- By using the Carwen platform, you agree to be bound by this Customer Agreement, our Terms and Conditions, and our Privacy Policy.
- If you are using Carwen on behalf of a business, you represent that you have the authority to bind that business to this Agreement.
2. Service Description
- Carwen is a platform that connects customers with independent drivers for various driving jobs, excluding passenger transportation.
- Carwen does not provide driving services directly. We facilitate connections between customers and independent drivers.
3. Customer Responsibilities
- Accurate Information: You agree to provide accurate and complete information when posting jobs on the platform.
- Legal Compliance: You agree to use the service for lawful purposes only and in compliance with all applicable laws and regulations.
- Respectful Conduct: You agree to treat drivers with respect and to maintain professional conduct in all interactions.
- Safety: You are responsible for ensuring that any goods transported are legal, safe, and properly packaged.
4. Job Posting and Acceptance
- Job Details: When posting a job, you agree to provide clear and accurate details about the job requirements, location, and any special instructions.
- Pricing: You acknowledge that drivers set their own rates. You agree to the rate proposed by the driver when you accept their offer for your job.
- Recurring Jobs: For recurring jobs, you commit to the agreed schedule. If you need to skip a week, you agree to notify the driver or Carwen at least 24 hours in advance.
5. Payment Terms
- Payment Methods: You agree to pay drivers directly using the agreed method (PayID or cash).
- Timing of Payment: Unless otherwise agreed with the driver, payment is due upon completion of the job.
- Business Subscriptions: If you are a business customer using our premium services, you agree to pay the monthly subscription fee of $39 AUD.
- No Commission: You acknowledge that Carwen does not take a commission from the amount you pay to drivers.
- Payment Disputes: You acknowledge and agree that Carwen is not responsible for arbitrating or resolving any monetary disputes between you and drivers. Such disputes must be resolved directly between you and the driver. Carwen will maintain a record of reported disputes, and excessive disputes may result in suspension or termination of your account. Carwen reserves the right to suspend both parties involved in a dispute from the platform pending resolution.
6. Cancellation Policy
- You may cancel a job without penalty up to 2 hours before the scheduled start time.
- For cancellations within 2 hours of the scheduled start time, you may be charged a cancellation fee of up to 50% of the agreed job price, at the driver's discretion.
- For recurring jobs, you must provide at least 24 hours notice to cancel or reschedule without penalty.
7. Ratings and Feedback
- You have the right to rate and provide feedback on drivers after job completion.
- You agree to provide honest and fair feedback based on your experience.
- You acknowledge that drivers may also rate and provide feedback on customers.
8. Liability and Insurance
- Carwen is not responsible for the actions or omissions of drivers or for any loss or damage to your property during a job.
- You acknowledge that drivers are required to have their own insurance, but Carwen does not guarantee the adequacy or validity of such insurance.
- For high-value items, you are encouraged to obtain appropriate insurance coverage.
9. Privacy and Data Protection
- You agree to our collection, use, and sharing of your personal information as outlined in our Privacy Policy.
- You agree not to share drivers' personal information for any purpose other than as necessary for the completion of the agreed job.
10. Dispute Resolution
- In the event of a dispute with a driver, you agree to first attempt to resolve the issue directly with the driver or through Carwen's support team.
- If the dispute cannot be resolved through these means, it shall be resolved through binding arbitration in accordance with the Australian Centre for International Commercial Arbitration (ACICA) Arbitration Rules.
11. Termination
- You may terminate your account at any time by contacting our support team.
- Carwen reserves the right to suspend or terminate your access to the platform for violations of this Agreement or our Terms and Conditions.
- Upon termination, you agree to complete any outstanding payments for services rendered.
12. Modifications to the Agreement
- Carwen reserves the right to modify this Agreement at any time. We will provide notice of significant changes via email or through the platform.
- Your continued use of the Carwen platform after such changes constitutes acceptance of the new Agreement.
13. Governing Law
This Agreement is governed by the laws of New South Wales, Australia. Any legal action or proceeding relating to this Agreement shall be instituted in a court in Sydney, New South Wales.
By using the Carwen platform, you acknowledge that you have read, understood, and agree to be bound by this Customer Agreement.
